Terms and Conditions of Sale
General terms of sale applicable to purchases made through the website of Azienda Agricola Cester Alberto.
1. General information
These Terms and Conditions of Sale govern the purchase of products through the website of Azienda Agricola Cester Alberto (hereinafter the “Seller”), with registered office at Via della Vittoria 34, 31043 Fontanelle (TV), Italy, VAT 04752650269.
Placing an order implies full acceptance of these Terms and Conditions and of the Privacy Policy. Each order is governed by the conditions published on the website at the time the order is placed.

2. Products
The products on sale are artisanal preserves and specialties from the orchard, grown and processed directly by the farm in keeping with family traditions.
As these are artisanal, seasonal productions, photographs and descriptions are indicative: small variations in appearance, colour or texture are natural and do not constitute a defect. Weight, ingredients, allergens and best-before date are stated on each product page.
Availability is subject to seasonal stock. Should an ordered product be unavailable, the Seller will contact the customer within 48 hours to offer an alternative or issue a full refund.
3. Prices
All prices are expressed in Euro (EUR) and include VAT.
Shipping costs are not included in product prices: the amount is clearly shown at checkout, before the order is confirmed. Any threshold for free shipping is indicated on the website.
The Seller may update prices at any time; changes do not affect orders already confirmed.
4. Orders and payments
The contract is concluded when the customer receives the order confirmation email, sent after successful payment. The Seller may decline an order in case of product unavailability, payment anomalies or an obvious pricing error: in such cases nothing is charged, or the amount is refunded in full.
Payments are accepted via:
- Credit or debit card (Visa, Mastercard, American Express) and any additional methods offered at checkout
Payments are processed by Stripe, a PCI-DSS certified provider, over a secure connection. Card details never pass through, and are never stored on, the Seller's systems.
5. Shipping
Shipping is available in Italy only. Products are prepared and shipped directly by the Seller via tracked express courier.
- Preparation time: 2–3 working days from payment confirmation.
- Delivery time: 2–4 working days from dispatch, depending on destination.
- Costs: the amount shown at checkout, before order confirmation.
- Free shipping: for orders above the threshold indicated on the website.
Upon delivery, customers are advised to check the parcel and report any visible damage as soon as possible: prompt notice is not a condition for exercising your rights, but it helps handle claims with the courier. The Seller is not liable for delays attributable to the courier or force majeure; if delivery fails due to an incorrect or incomplete address provided by the customer, any storage and re-shipping costs are borne by the customer.
6. Right of withdrawal
Consumers have the right to withdraw from the contract within 14 days of delivery of the products, without giving any reason, pursuant to Articles 52 et seq. of the Italian Consumer Code (Legislative Decree 206/2005).
To exercise this right, it is sufficient to send an explicit statement within that period (the statutory model withdrawal form or any written communication is fine):

Exceptions (Article 59 of the Consumer Code): withdrawal does not apply to sealed products unsuitable for return for hygiene or health-protection reasons once opened after delivery, nor to goods liable to deteriorate or expire rapidly (for example, any fresh produce). Unopened, sealed jars and packages therefore remain eligible for withdrawal.
In case of withdrawal, the Seller refunds the product price and standard delivery costs within 14 days of the notice, using the same payment method as the purchase; the refund may be withheld until the products are received back or proof of their return shipment is provided. The customer must return the products without undue delay, and in any case within 14 days; the direct cost of returning the goods is borne by the customer. The customer is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature and characteristics.
The right of withdrawal is in addition to the legal guarantee of conformity described in section 7 and does not limit it in any way.
7. Legal guarantee of conformity
The products sold conform to the descriptions published on the website and to the hygiene and labelling regulations applicable to food products.
The legal guarantee of conformity under Articles 128 et seq. of the Italian Consumer Code (as amended by Legislative Decree 170/2021) applies: it covers lack of conformity that becomes apparent within two years of delivery, within the limits of the natural shelf life of food products. Any lack of conformity that becomes apparent within one year of delivery is presumed to have existed at that date. The law sets no time limit for reporting a defect.
In case of lack of conformity (for example, a product damaged in transit, compromised packaging, or a product not matching its description), the customer is entitled to a replacement or, in the cases provided for by law, to a price reduction or termination of the contract with a refund. Prompt notice, ideally with photographs, is not mandatory but allows faster handling.
8. Complaints and returns
For any complaint or return request, simply contact the Seller providing:
- Order number
- Description of the issue
- Photographs of the product (in case of defects or damage)
The Seller will reply within 5 working days with a proposed solution. For faster handling, please agree on the return arrangements in advance; the rights set out in sections 6 and 7 remain unaffected in any case.
Except in cases of lack of conformity, returned products must be intact, sealed and adequately packaged. Return costs are borne by the customer in case of withdrawal, and by the Seller in case of lack of conformity.
9. Governing law and jurisdiction
These Terms and Conditions are governed by Italian law. For any dispute, the parties undertake first to seek an amicable solution in good faith.
Should the dispute not be resolved out of court, the Court of Treviso shall have jurisdiction, unless the customer qualifies as a consumer under the Italian Consumer Code, in which case the courts of the consumer's place of residence or domicile shall have jurisdiction.
Consumers may also resort to out-of-court dispute resolution procedures before ADR bodies, pursuant to Articles 141 et seq. of the Italian Consumer Code.
